01. Using Banamind
These Terms govern access to the Banamind website and furniture sales software provided by Banamind LLC, License No. 2646864.01. By using the service, you accept these Terms. If you use Banamind on behalf of a business, you must have authority to bind that business. Do not use the service if you do not agree. A separately signed agreement takes precedence where it conflicts with these Terms.
02. Our service
Banamind helps companies across the office furniture industry qualify inquiries, select products from their catalogs, prepare layouts and visualizations, generate itemized quotes, and manage sales conversations through an AI Sales Agent. Available features may include virtual tours, CAD or Revit outputs, and connections to CRM, ERP, and communication systems. Features, integrations, and service scope depend on your agreed plan or order form.
03. Accounts and authorized use
Keep account credentials secure and manage permissions for your team. You are responsible for activity carried out through your account and for promptly reporting suspected unauthorized access. Do not misuse the service, bypass security controls, upload unlawful content, infringe others’ rights, or use automated communications for spam or deception.
04. Your catalog and customer information
You retain ownership of the catalogs, product images, SKUs, configurations, prices, availability, floor plans, and customer information you provide. You grant Banamind permission to process that information as needed to deliver the service. You must have the rights and permissions needed to upload it, connect external systems, and communicate with your customers. Keep product and commercial data accurate and current.
05. AI outputs and commercial decisions
AI-generated quotes, layouts, product suggestions, and visualizations can contain errors or omissions. Review quantities, dimensions, configurations, prices, availability, margins, taxes, delivery terms, and final customer commitments before approval. Visualizations illustrate a proposed space and are not a substitute for technical verification, building approvals, or professional advice. Banamind does not guarantee a particular win rate, revenue increase, profit margin, or sales outcome.
06. Integrations and sales communications
You control which systems and communication channels are connected and which actions are authorized. Third-party services remain subject to their own terms and availability. You are responsible for obtaining any required consent for customer messaging or call recording and for configuring approval rules. Banamind does not bind your business to an order beyond the authority you grant through your agreed workflow.
07. Subscriptions and service changes
Fees, usage allowances, trial conditions, payment schedules, renewals, and cancellation terms are set out in the applicable order form or subscription agreement. We may update or change the service. Any changes to contracted commitments remain subject to that agreement.
08. Intellectual property and privacy
Banamind and its licensors retain rights in the software, branding, and service technology. Your use of the service does not transfer those rights. Our Privacy Policy explains how personal information is handled. Where we process customer personal data on your behalf, the applicable data processing agreement governs that processing.
09. Liability
To the extent permitted by applicable law, Banamind is not liable for indirect or consequential losses, including lost profits, arising from use of or inability to use the service. Unless a separate agreement provides otherwise, our aggregate liability is limited to fees you paid to us during the twelve months before the claim. Nothing in these Terms excludes liability or rights that cannot lawfully be excluded.
10. Suspension and termination
We may suspend or terminate access for a breach of these Terms, misuse, security risk, or as permitted by your agreement. Your right to access the service ends on termination. Data return, deletion, and any continuing payment obligations are handled under the applicable agreement and Privacy Policy.
11. Updates and contact
